- to perform.
- ..
- 28. Doctor Hsu planned and supervised my radiation at UCSF. On
- 090205, he noted in examination that IBC was most severe and
- intense in the breastbone area that presented a bleeding wound.
- ref SDS 9 PR5K
- ..
- 29. Doctor Hsu advised that delay starting treatment at UCSF caused
- IBC to get worse, so UCSF changed the work plan from
- hyperthermia and Doxil (systemic agent) ordered by Doctor Rugo,
- to more rigorous care with radiation and hyperthermia. Doctor
- Hsu further increased the amount of radiation. ref SDS 9 EY5F
- ..
- 30. Doctor Hsu advised that changing from Doxil to radiation
- delayed starting treatment to allow time for laying out
- radiation zones and to order fabrication of molds that guide
- comprehensive treatment. This additional preparation delayed
- treating my cancer another 2 weeks in order to avoid mistakes,
- making a total of 4 weeks delay. The first treatment was on

- study on 040517 1200. ref SDS 2 S66O...] Doctor Hsu advised
- that I was mistaken. He said that my radiation had been laid
- out for comprehensive treatment. The doctor noted that IBC
- looks similar to reaction to radiation, so patients are easily

- 35. A few weeks later on 090330, I met with Doctor Hsu at UCSF for
- follow up examination. I was suffering pain from severe
- blistering reaction to radiation, which was expected. I asked
- again about the wound on my breastbone because it was still
- bleeding, oozing puss, and felt differently from other areas.
- I was assured again this was reaction to radiation. ref SDS 20

- sprinkled rash suddenly on my lower left arm. ref SDS 21 Q64R
- Doctor Hsu immediately advised this was likely IBC recurrence.
- ref SDS 22 R24X

- 37. I requested treatment [reported on 090401 0046. ref SDS 23
- RE8P] Doctor Rugo responded in a letter saying UCSF had to
- delay treating expanding IBC on my arm until the wound from
- radiation in my chest healed. ref SDS 24 K56O
- ..
- 38. Doctor Rugo's prescription to delay treatment for IBC applied
- Doctor Hsu's diagnosis that the "wound" was reaction to
- radiation that could heal. Since the wound was cancer, it
- could only heal with treatment for cancer. Therefore delaying
- care on 090401, caused a small cancer in the breastbone to grow
- into a huge medical problem, which I face today.
- ..
- 39. This was not discovered until 090607. I noticed the wound in
- my chest was still getting worse, while other radiation
- blistering had nearly healed. In March, Doctor Hsu asked me to
- let him know if radiation blistering didn't heal in 3 months,
- and in that case, he would prescribe medication to speed
- healing. On 090607, I asked for examination to get the special
- medication for the wound in my chest. ref SDS 28 MU6P
- ..
- 40. On 090609, Doctor Hsu changed diagnosis of the wound from
- reaction to radiation to untreated cancer caused by mistakes
- providing radiation services on referral from Kaiser. He said
- UCSF is awfully sorry, but the special medication planned for
- the wound back in March, wouldn't really work in June. He
- explained that since cancer was untreated for 6 months, it
- spread everywhere outside the zones treated with radiation, and
- so needed systemic treatment. He was also concerned that
- untreated cancer in the breastbone area went to my lungs,
- because breathing was increasingly difficult. He was further
- concerned that radiation to treat IBC on my chest, may have
- caused injury to my lungs. A great many problems piled up all
- at once. ref SDS 29 W65W
- ..
- 41. The 5 month delay at UCSF discovering mistakes that made my
- cancer worse, occurred years earlier at Kaiser. From January
- 2003, to May 2004, IBC on my left breast was diagnosed as
- reaction to radiation, and treated for Cellulitis. On 040504,
- Doctor Johnson came into the Chemotherapy Clinic when I was
- getting treatment. He knelt down putting his hands on the arm
- rests. Looking into my eyes, he said Kaiser is awfully sorry
- about delaying my treatment, and would do everything possible
- for me to recover. ref SDS 1 WI8F
- ..
- 42. Like Doctor Johnson in 2004, in June 2009, Doctor Hsu took
- immediate action to correct the problem. He ordered CT testing
- and labs, and prescribed treatment with MPA targeted to my
- patient profile, with work to be performed by Doctor Rugo and
- her team in the Breast Care Clinic. I was grateful that
- targeted treatment recommended by Doctor Johnson at Kaiser, and
- by Doctor Rugo was at last prescribed for my recovery of the
- 8th relapse. ref SDS 29 1P3K

- 43. Doctor Hsu's findings were reported to your office the next day
- in a letter on 090610, because on 090521, Expedited Claims
- transferred jurisdiction to the Claims Resolution Department,

- ..
- 45. The next day on 090611, UCSF sent a letter to Kaiser offering a
- requisition to pay for CT and blood tests ordered from Kaiser
- to expedite my treatment at UCSF, and demonstrating UCSF taking

- 46. The following week during a meeting at UCSF on 090616, Doctor
- Rugo advised that my care for cancer and breathing problems was
- transferred to UCSF. She provided contacts for me to call
- UCSF, rather than Kaiser on cancer and breathing problems.
- ref SDS 33 EE70
- ..
- 47. At the same meeting on 090616, Doctor Rugo reported "everybody
- is on board" at Kaiser and UCSF for a work plan to recover from
- my injuries caused by UCSF medical mistakes. She related that
- Kaiser and UCSF agreed in a letter to treat my cancer as a
- chronic disease with therapy "targeted" to my patient profile,
- beginning with MPA, prescribed by Doctor Hsu, and after MPA the
- next treatment would be PARP, which targets my triple negative
- status. ref SDS 33 KD6L
- ..
- 48. Doctor Rugo ordered tests at Kaiser for status change in
- October 2008, and discovered I am still triple negative [...
- reported on 081016 2342. ref SDS 4 J36R...]. This prevents
- using many powerful new drugs to treat my cancer. Far fewer
- drugs are designed for triple negative, because there are fewer
- patients. Since Cetuximab targeting triple negative status
- controlled my cancer for nearly 2 years starting in 2007, PARP
- targeting triple negative seems promising.
- ..
- 49. PARP in UCSF's work plan presented on 090916, was strong
- evidence the medical team performed standard of care for my
- patient profile that requires proactive planning, ordered by
- Doctor Johnson. After MPA and PARP there are 20 or so more
- treatments targeted for my patient profile (see above,
- ref SDS 0 X77U). Since I am ECOG performance score 0, able to
- lead a normal life with timely treatment, I was relieved that
- the medical team was well prepared.
- ..
- 50. Doctor Rugo's report on 090616, that "everybody is on board,"
- offered a "road map" to a future worth living. Treatment
- "targeted" to cancer is effective without devastating side
- effects. This takes comprehensive planning, management, and
- collaboration (shown above, ref SDS 0 X766).
- ..
- 51. As noted above, on 080829, Doctor Johnson began asking me to
- get a list from UCSF for my future treatments at UCSF, because
- my cancer mutated to resist chemotherapy available at Kaiser.
- ref SDS 10 PT3N Each time I relapse there is less time to
- stop cancer from cascading out of control. Proactive planning
- is therefore essential for my patient profile now on the 11th
- relapse in order for treatment to start in time to be
- effective. UCSF reported having many treatments lined up for
- me. However, on 090121, UCSF called and said they lost their
- list. Doctor Rugo's coordinator said the doctor asked me to
- help construct a list from my record of patient history.
- ref SDS 5 Y67L I ordered a 2nd opinion to develop a
- comprehensive list of treatments "targeted" to my patient
- profile. On 090325, Doctor Johnson asked me for the list,
- reflecting Kaiser's policy to rely on 2nd opinions. ref SDS 18
- GO4O Kaiser has implemented all of the recommendations in 6
- prior 2nd opinions I obtained. (see evidence from case study on
- 090213. ref SDS 10 J58K
- ..
- 52. On 090326 (the next day), I submitted the 2nd opinion to the
- medical team, requesting standard of care comparing trade-offs
- to evaluate results and costs in terms of suffering, time, and
- money, as Kaiser had done with prior 2nd opinions, and for the
- purpose of proactive planning ordered by Doctor Johnson, and
- requested by UCSF. Only Doctor Johnson responded, saying in a
- letter that this would be discussed during the next meeting at
- Kaiser. ref SDS 19 T64N This, however, has never been done,
- shown by case study on 090213. ref SDS 10 PT3N
- ..
- 53. Since, PARP is among treatments listed in the 2nd opinion
- submitted to the team on 090326 [citing research on 090204,
- ref SDS 8 9J6Y, and listed the claim above, ref SDS 0 X76W], I
- relied on representations in the meeting on 090616, that Kaiser
- and UCSF were providing standard of care required in my
- insurance agreement with Kaiser, and for UCSF to repair
- injuries caused by medical mistakes.
- ..
- 54. I asked for a copy of the letter.
- ..
- 55. Doctor Rugo advised that the letter covered other patients, as
- well as my case, and so UCSF refused submission. ref SDS 33
- U46K
- ..
- 56. The next day on 090617, I sent a letter to the medical team
- (Doctor Johnson, Doctor Rugo, Doctor Hsu and others) confirming
- that UCSF and Kaiser agreed in a letter on a work plan for me
- to recover from UCSF medical mistakes, starting with MPA, and
- then PARP. ref SDS 34 VS9P
- ..
- 57. Resolution of my claim can therefore be aided by production of
- the letter between Kaiser and UCSF agreeing that UCSF would
- treat my cancer as a chronic disease for recovery from UCSF

- 58. A month later, on 090716, UCSF called and ended treatment with
- MPA, because breathing problems increased. UCSF noted that
- blood clots are a rare side effect of MPA, which can impair
- breathing. Earlier in May on 090514, Doctor Rugo diagnosed my
- breathing problems were caused by radiation injury shown by CT

- ref SDS 26 NL9I Testing has found no evidence of blood clots

- 59. I expected to be treated with PARP, agreed in the letter
- between Kaiser and UCSF, reported on 090616. UCSF called on
- 090716 at 0800p late in the evening, and advised that Doctor
- Rugo was traveling, and that she sent a letter to Kaiser
- disclosing that PARP would not be ready until September, and
- UCSF had an emergency because the team had not lined up
- treatments from list submitted on 090326, despite assurances to
- the contrary, and so UCSF wanted me to get Gemzar at Kaiser,

- 61. Resolution of my claim can therefore be aided by production of
- Doctor Rugo's letter to Kaiser on 090716, showing UCSF
- continuing to correct medical mistakes that injured me, and by
- amending agreement on 090616.
- ..
- 62. Kaiser and UCSF knew that Gemzar and other chemotherapy agents
- presented great risk for me of infection, pain and suffering
- that diminish ability and will to live, and cause death from
- side effects that are worse for my patient profile in the 11th

- abandoned, because I had not heard from UCSF, since the call in
- mid-July. I was worried that UCSF had defaulted on referral
- obligations to correct medical mistakes, and this would create
- a raft of new complications and more delay getting someone else

- ..
- 72. In a meeting at Kaiser on 091027, Doctor Johnson reported "good

- aligned with an unexpected drop in the cancer marker CA 15-3
- 299. The doctor explained this buys the medical team some time
- to find my next treatment. He also reported bad news. His
- schedule changed, so he did not have time after meeting on

- patient profile, as planned in the meeting on 091027. Since

- having collaborated through email with Doctor Rugo on my care,
- and that she related PARP was still not ready for me at UCSF,
- and further that UCSF approved Kaiser treating me with

- hall to get the email with Doctor Rugo. After 10 - 20 minutes,
- Doctor Johnson returned and reported that he found nothing in
- his files from Doctor Rugo pertaining to my care. He couldn't
- find the letter Doctor Rugo cited on 090616; nor the letter
- Doctor Rugo sent to him on 090716, nor the letter cited during
- the meeting on 091112 showing UCSF approved Kaiser treating me
- with Navelbine chemotherapy. He then related guidance at
- Kaiser that Federal HIPAA regulations deny patients access to
- communications on their health care. This was discussed at the
- meeting citing HIPAA language reported on 071109 that grants

- including communications. ref SDS 45 LQ5N

- 80. Resolution of my claim can therefore be aided by production of

- 81. The medical chart for the meeting at Kaiser on 091112
