- 1. When time permits, could you let me know progress on getting

- 1. I am so sorry it is costing you time. I really have to
- apologize for not being able to just email you. That is one
- area where HIPPA (the government agency that 'watches over' the
- medical stuff) is very very strict. The hospital policy is that
- only the dept. of medical records is custodian of these legal

- Doctor Guardino met with Millie for 45 minutes on 041019. Denise
- seems to indicate that government regulations prevent doctors from
- writing a letter to the patient confirming understandings in order to
- avoid error, and further prevents the doctor from reviewing patient's

- 2. I hope you are not offended--it is just the hassels of being in
- a big institution that has many rules in place. (being a big
- place, we are often a target for lawsuits, on frivolous, minor

-

- frivolous "bending of the rules? One solution is to change the rules.
- This was discussed with California Supreme Court Justice Stan Mosk on
- 911130. ref SDS 1 7007

- Suppose the "rules" were changed to require good medical practice by

- timely communication to make the doctor patient partnership effective
- with timely feedback, called by industry standards on 990625.
- ref SDS 6 3190 If the rule was change to require good management then
- would people stop fearing that taking the initiative "bends the rule"?

- 1. Thanks so much for your letter on Nov 8. It's good to know
- people are trying, even though admin and legal constraints in
- big organizations prevent efficiencies. In my career spanning
- 50 years, like you, I have learned a lot of "lessons," and so I
- know how you feel about getting cross-wise with the boss.

- Lessons learned...
- ..
- Millie continues...
-
- 2. Accordingly, this is not to convey medical information, nor to
- request that you submit anything to the doctor, but rather to
- provide context. Last week I was told that a new CT test on
- 041103 showed a few small blood clots in my lungs. The doctor
- advised that these clots likely cause heaviness in the chest
- and coughing I have reported over the past 3 or 4 months, and
- discussed with Doctor Guardino, when we met on 041019. At that
- time Doctor Guardino commented that Xrays showed no problems.
- Now there is new data.
- ..
- 3. In particular, the CT test report dated 041103 states in
- part...
- ..
- "Since the previous exam, [...on 040921 which Doctor Guardino
- saw] there are now filling defects within the primary branches
- of the right upper lobe and right lower lobe pulmonary arteries
- consistent with pulmonary emboli. A small hiatal hernia is
- identified."
- ..
- 4. As a result, I have been taken off the Avastin trial, and so
- face a different set of decisions. Hopefully medications will
- clear the clots in a few weeks and I can get chemo treatment
- again.
- ..
- 5. I visited Stanford on 041019 for a 2nd opinion on treatment in
- light of the Avastin trial, as set out in my letter to Stanford
- on 041002. Now that the trial has ended for me, and I am no
- longer getting treatment, the challenge is to devise a new work
- plan. In our meeting on 041019 (the part you didn't attend)
- Doctor Guardino indicated she had some ideas which she would
- present in her opinion, and, further, she planned to call my
- doctor at Kaiser to discuss her views.
- ..
- 6. Since Doctor Guardino has not yet submitted a 2nd opinion, I
- would like her to be apprised of this change in my condition in
- order to offer useful comments?
- ..
- 7. Since blood clots visible in the CT test on 041103 are cited as
- a possible cause of problems going back many months, I am
- curious if Doctor Guardino observed any evidence of blood clots
- from her examination of CT scan films on 041019. At that time
- she mentioned having looked at all of the prior scans going
- back to 2002. The narrative reports do not mention blood clots
- for the prior scans, but we have found uneven reporting, and so
- prior scans may also show clotting. Did Doctor Guardino notice
- this when she made her review on 041019?
- ..
- 8. Again, I realize you probably cannot convey any of this to the
- doctor, and it is not my intent to encourage action contrary to
- Stanford policy. You have been great, and I don't want to do
- anything that impacts you.
- ..
- 9. Could you please tell me how patients get timely information to
- the doctor for rendering a current opinion?
- ..
- 10. For example, would it help for me to print this letter and mail
- it to the doctor, along with a copy of the new CT test results?
- What is the address for mailing? Would Stanford want another
- $600?
- ..
- 11. Finally, could you give me a telephone number to call medical
- records to get what is currently available, or should I wait to
- see how this new information impacts the doctor's report?
- ..
- 12. Thanks very much for help working with the "Stanford system" to
- get a new treatment plan.
