100803 - We did an exercise to find Voith's Dec 10, letter.  Wayne expressed a
100804 - concern that if speed increaser corrections are held to be warranty
100805 - work, then DNRC cannot recover costs of engineering and so forth. This
100806 - interpretation may not be entirely correct.  GC 13.12 appears to be
100807 - the contract warranty provision and permits the Owner to recover sup-
100808 - port costs, if the Contractor fails to perform.  The main issue on
100809 - warranty is whether DNRC can recover the costs of delays, such as lost
100810 - revenue.  I suppose an argument might also be made that Owner support
100811 - costs are only recoverabe if the contractor fails to make the repairs.

100813 -     This requires a complex analysis of Voith's conduct where, after
100814 -     protracted denials, it agrees to perform, and whether subsequent
100815 -     delay thereon constitutes sufficient causation for the Owner to
100816 -     incur support costs.  It would seem so to me, but that will only
100817 -     arise as an issue if Voith can overcome the record showing the
100818 -     speed increaser is in fact contract work.

100820 - In any event since the parties agree the speed increaser is punch list
100821 - work, per Voith's Dec 10, letter, the matter appears moot, since GC
100822 - 13.11 permits recovery of all necessary and reasonable Owner support

100826 - Tudor and Voith, that the speed increaser is warranty work.  So far he
100827 - has not indicated an awareness of having been misled.  There would be

100830 - factual representation on this matter contrary to DNRC interests.

130822 - We considered how to get Power to use the SDS doc log.  One idea was

130825 - Wayne feels that Power probably cannot do this.  He feels though that
130826 - it would be helpful to get the documents inventoried with the RBase
130827 - system, then have the important documents entered into the SDS doc log

130830 -    This may be so, however, there remains a residual concern that DNRC
130831 -    has a large body of documents inventoried in the SDS doc log and
130832 -    will subsequently introduce a different system with lessor capbili-
130833 -    ty and requiring significantly greater investment in learning.  The
130834 -    liklihood of confussion in the record is greatly enhanced by this
130835 -    step.
