0607 - ..
0608 - Summary/Objective
0609 -
060901 - I explained the issues at ref SDS 21. Wayne feels a meeting might be
060902 - helpful, but is concerned about reservations by Voith and DNRC staff
060903 - of having Welch do this task.
060904 -
060905 - Considered the advantage to DNRC of Welch focusing on Voith's
060906 - conduct in the SDS record rather than elsewhere.
060907 -
060908 - Wayne cited the potential for Voith to misrepresent what Welch
060909 - might say in a way that would harm DNRC. Upon discussion he
060910 - recalled that Sletten and Voith were not successful in similar
060911 - attempts. Whatever they said later proved to be helpful to DNRC.
060912 - Thus, DNRC could greatly benefit from getting this into the pro-
060913 - ject record, for the reasons stated at ref SDS 21 line 86.
060914 -
060915 - Scheduling a meeting with Voith simply requires calling to say we
060916 - wish to drop by to discuss preparations for the Helena meeting.
060917 - The contractor is required to meet with Owner's representative
060918 - for reasonable and necessary business. Voith would likely wel-
060919 - come a meeting to move the project ahead.
060920 -
060921 -
060922 - We considered Wayne attending the meeting to make it a Voith executive
060923 - matter. I explained that this might be helpful to provide an oppor-
060924 - tunity for Voith decision making authority to hear perhaps for the
060925 - first time the difficult situation Voith faces and how to solve it.
060926 -
060927 -
060928 - Decision Matrix Helpful
060929 -
060930 - Discussed the prospects of this effort resulting in accomplishing
060931 - DNRC's objectives, and the need to obtain information from Voith as
060932 - the responsible and most knowledgeable party of a custom designed
060933 - power plant.
060934 -
060935 - Wayne expressed concern that Voith might provide information that is
060936 - inaccurate in order to further its own interests.
060937 -
060938 -
060939 - Voith Has the Information
060940 -
060941 - We considered how such eventuality could be overcome by investigating
060942 - the correctness of actual objections if raised, rather than incurring
060943 - significant lost time and expense on matters for which there may well
060944 - be no objection and yet still be at risk of incurring objections on
060945 - material design issues which are only known to Voith.
060946 -
060947 - Thus, if Voith makes objections such will focus the time and expense
060948 - of experts on real problems.
060949 -
060950 - Wayne will review the matter with DNRC staff.

1006 - Discussion
1007 - ..
100701 - Wayne indicated there are still some hurt feelings about Welch
100702 - helping DNRC with Broadwater. He said general expressions continue to
100703 - come up about "When is Welch leaving, so we can get some work done."
100704 -
100705 - He does not seem to feel I am impeding the work, except for the
100706 - general discomfort from the staff on working with me and the pressure
100707 - of SDS, per our discussions at ref SDS 2 4839 and ref SDS 5 3354.
100708 -
100709 -
100710 - Concept
100711 -
100712 - Maybe the best course is for Welch to leave the DNRC offices for
100713 - awhile so there is less tension in the air. This would permit work on
100714 - claims to proceed unencumbered by the vagaries of daily events which
100715 - otherwise get attention and about which there is clearly divided
100716 - opinion as to its value.
100717 -
100718 - [See follow up at ref SDS 22 line 113 and ref SDS 23 line 99, ref SDS 25 line 62.]
