0810 - 1405 discussion Al Sanchez and Dennis Diemer
0811 -
081101 - Al and Dennis stopped in my office after meeting with Paul. They
081102 - said they liked my work in responding to claims, but asked if the
081103 - claimants were being informed of what they needed to do in order to
081104 - recover. I explained that the claim responses I have prepared indi-
081105 - cate to the claimants the basis of the determinations, as required by
081106 - the contract.
081107 -
081108 - I mentioned that except for the Willis claim, the claims I have
081109 - reviewed are not well supported. I also indicated there appears to
081110 - be some exposure by the District in the Vela matter. This relates to
081111 - the elevator guide supports. Even though the District may not be
081112 - liable in the case of LCA having directed Vela to perform the work,
081113 - the ultimate liability to LCA may still lie because the elevator
081114 - contractor was not responsible for the structural shaft.

0813 -
0814 - 1420 discussion with Paul
0815 - ..
081501 - Advised Paul of comments by Dennis and Al. Paul said they had
081502 - discussed my work briefly, and mentioned they thought my claims
081503 - responses are too "wordy" in some respects.
081504 -
081505 - Paul said Dennis objected to my responses to contractor claims which
081506 - explain specific defects were found in their claims, and that
081507 - corrections of same would permit the District to pay otherwise valid
081508 - claims (in accordance with the ideas at ref SDS 2 8492).
081509 -
081510 - I recommended that the District be forthright about its obligations
081511 - and willingness to pay valid claims, rather than simply deny a duty to
081512 - pay a properly supported claim, per analysis on "Command and Control
081513 - of the Record," at ref SDS 1 8493.
