0403 - ..
0404 - Summary/Objective
0405 -
040501 - Jeff asked about the 880919 Diary record. ref SDS 4 7458
040502 -
040503 - Initially, he had a document submitted to Paul Robinson, and asked if
040504 - it is part of the SDS diary record?
040505 -
040506 - I affimred that it is an extract from the SDS record, same as notes of
040507 - Progress meetings and all other documents I have prepared for Tudor
040508 - are extracts from the Diary.
040509 -
040510 - Jeff said that it was incorrect to have issued the document under my
040511 - own name, that rather he should sign such submittals. He further
040512 - advised that Tudor does not distribute its Diary to others, nor to the
040513 - Contractor.
040514 -
040515 - He said that he retrieved the copy that was to be mailed to Sletten's
040516 - office in Great Falls for Bill Merriam. He asked whether the copy
040517 - had been picked up by Sletten's field office.
040518 - ..
040519 - I advised that the document has been obtained by Sletten.
040520 -
040521 - Jeff asked me to retrieve it. Since the Progress meeting was about to
040522 - begin, the Sletten people were arriving and so Jeff asked Paul
040523 - Robinson if he had received the document. Paul said yes and he had
040524 - prepared a response. Jeff asked him to return the document, and Paul
040525 - after inquiring to make sure he understood the request correctly,
040526 - agreed to return the document.
040527 -
040528 - Need to address use of SDS for Command and Control of the record to
040529 - clarify and explain objectives for Tudor management. Tie into
040530 - assignment. Explain concepts.

0408 -
040801 - During the Progress meeting today, ref SDS 6 6038, Bill Merriman
040802 - inquired about the intent of the Notes for the prior meeting on
040803 - 880914. ref SDS 2 0026 The intent is expressly stated, in placing a
040804 - burden on Sletten to support its entitlement in accordance with
040805 - standard contract practice (the Claimant must prove its a prima facia
040806 - case).
040807 -
040808 - An additional purpose was to provide some relief for the Engineer in
040809 - reducing the volume of letters it has committed to furnish.
040810 -
040811 - In this case Jeff agreed to furnish the letter.
040812 -
040813 - Additionally, Bill Merriman's inquiry occurred in the absence of an
040814 - explanation which was created for the record to deal with this
040815 - occurrance, see ref 11 line 061211 to 061239. These lines were
040816 - omitted in the Notes furnished to Sletten, ref 10.
040817 - ..
040818 - It is not contended the decision to omit was an error. This
040819 - record does, however, illustrate the use of the Diary which is
040820 - intended to provide a data base for advocating the interests of the
040821 - State and Tudor. Mr. Merriman's question would ordinarily have been
040822 - referred to the cite. Since the citation was not available, some
040823 - scrambling was necessary.

050301 - Need list of letters from Paul Robinson.
050302 -
050303 - Paul didn't provide this today. (see also the Progress meeting).
050304 -
050305 -
050306 - Jeff asked me to concentrate on creating this list for the next
050307 - major project, rather than the change orders.
050308 -
050309 - He wants to see a list of documents Sletten has submitted for which
050310 - there are no responses from Tudor. Asked to begin with August.
050311 -
050312 -
050313 - I put the documents back on Jeff's desk which had been removed by
050314 - Wayne Wetzel and Norm Barnard this morning in preparation of Progress
050315 - meeting with Sletten. In doing so, I arranged them in what seemed to
050316 - be associated groups and noticed that these documents may constitute
050317 - the list Tudor is seeking.

060404 - require clarification in the subsequent meeting.

Change Order Review

0704 -
070401 - Began looking at this today.
070402 -
070403 - Sletten submitted its list of Claims and Change orders it feels are
070404 - pending answers from the Engineer.
070405 -
070406 - Many of these are frivoulous. The "Triangle Fabrication" claim for
070407 - extra time has been discussed as recently as Tuesday, and Sletten
070408 - agreed to furnish additional information. This understanding was
070409 - among the matters in the Diary which Jeff asked to be retrieved.
070410 -
070411 - The $225,000 amount paid to Sletten for acceleration for "...the 30
070412 - day period..." is not very helpful. Could be used to show a
070413 - stipulation as to monthly cost of acceleration.
070414 - ..
070415 - If Sletten wins the acceleration point, then damages could be
070416 - real big very fast.

090502 - Gracon Landing Not Effective Due to Sletten Failure to Cooperate
090503 -
090504 - While driving back from the Post Office about 1300 Rod Welch noticed
090505 - Gracon attempting to dock its barge on the bank landing. They
090506 - appeared to be having trouble. Got Jeff and we went over to take a
090507 - closer look.
090508 -
090509 - Dale was just coming up the bank and we asked how he was doing. Dale
090510 - advised that they experienced more difficulty than expected based on
090511 - prior attempts to dock, due to the greater current resulting from the
090512 - operation uderway to lower the reservoir by 2 feet. Dale explained
090513 - they did not have this kind of trouble on the prior occassions.
090514 -
090515 - Rod suggested Gracon consider running another line to the landing so
090516 - they have a positive control for the landing operation. Dale said
090517 - they need another deck winch for this. He also expressed concern
090518 - about the line interfering with fishermen who might frequent the area.
090519 - Rod suggested the line could be slacked off when it is not in use so
090520 - it would lie on the river bottom. Upon discussion this may not be
090521 - practical.

090530 - Looking at the area with Dale and Jeff, there does not appear to be a
090531 - viable alternative to using the existing landing. The water is too
090532 - shallow downstream to land the barge.

120405 - knee. Had hoped the problem would clear up by not playing tennis, but
120406 - that is not happening. I can barely get around now, and the work here
120407 - requires being mobile, per above. ref SDS 0 2066
120408 -
120409 - When I was out on the Dam to review Gracon's operation to install the
120410 - rubberized equipment, I thought I would not be able to get back to the
120411 - trailer, because just lifting the knee is very painful now. Putting
120412 - weight on it is worse. I had to walk a few steps, then rest -- took
120413 - 30 minutes to the end of the dam, down the ladder, across the

140703 -
140704 - Primary purpose of Dave's visit was to advise that a Union Business
140705 - Agent or representative was on site and had given indications that
140706 - the job will be struck tomorrow. Dave said that Sletten is preparing
140707 - now to post signs to designate alternate access routes. He request-
140708 - ed that the Engineer have Gracon do the same so the Sletten people
140709 - can enter the job without being affected by picketing aimed at
140710 - Gracon.
140711 -
140712 - Jeff said that Gracon has constructed entry signs and is ready to
140713 - post them. He will advise them to do so.
140714 -
140715 - Dave also advised that he believes Gracon people may be using
140716 - Sletten's access and that this could undermine the idea of having
140717 - alternate entry's. Jeff will inform Gracon to direct its work force
140718 - to use the Gracon gate.

160502 - Sletten Needs Skilled Support from Voith to Meet Schedule
160503 -
160504 - I asked Dave how confident he is of Sletten being able to meet the
160505 - 881017 completion objective. Ken Carlson was present during the
160506 - meeting.
160507 -
160508 - I explained it appears that Curb Ring installation is already 1 week
160509 - behind Sletten's schedule. Dave acknowledged this.
160510 -
160511 - Dave indicated there is still a "good possibility" this can be done.
160512 - He repeated Sletten's position that delay will be due solely to the
160513 - greater tolerances. He said Sletten will put the Curb Ring to the
160514 - tolerances it holds are contract requirements, then request a change
160515 - order to achieve the 880803 Determination tolerances. The time needed
160516 - to meet those tolerances will control when Voith can commence its
160517 - contract work.
160518 - ..
160519 - I asked how then Sletten could expect to complete by 881017 if
160520 - the cadwelding will require 8 more work days?
160521 -
160522 - Dave said this could be done on an accelerated basis. He added, he is
160523 - unsure how it will actually turn out.
160524 -
160525 - I asked if Sletten could be aided in meeting its projected completion
160526 - dates, if a Voith mechanic, who has more experience in that kind of
160527 - work, performed the Curb ring operation?
160528 -
160529 - Dave advised that some of the 10 day activity duration is for forming
160530 - and reinforcing steel placement.
160531 -
160532 - I asked how much of the 10 days is for that?
160533 - ..
160534 - Dave didn't know.

160537 -
1606 -
1607 -
1608 - 1400 Ken came by for an extended visit with Jeff.
1609 -
160901 - Ken said he believes that if Sletten is claiming it can complete the
160902 - Curb Ring activity in 10 days, it will likely take 15 days based on
160903 - their record of performance. He is doubtful that Sletten will
160904 - perform as promised in the meeting this morning.
160905 -
160906 - Jeff confirmed that Voith should schedule to start its Contract work
160907 - on 881017, based on representations from Sletten that it will be
160908 - ready on that date. Jeff feels that the 3 weeks between now and
160909 - 881017 is adequate to perform the work needed for Voith to begin its
160910 - contract.
160911 - ..
