050501 - Follow up
050502 -
050503 - Another driver caused a minor traffic accident, while Millie was
050504 - leaving the BART station this evening. Both parties agreed before
050505 - leaving the scene that there were no injuries nor damage to either
050506 - vehicle.
050507 -
050508 - [On 060330 received notice the other driver later made a claim for
050509 - damages and the insurance company determined Millie was 100%
050510 - responsible and principally at fault for the accident. ref SDS 2
050511 - TC84
050513 - ..
050514 - [On 060330 Millie submitted this record of the accident showing
050515 - the other motorist was responsible and that no damages occurred.
050516 - ref SDS 2 753N
050518 - ..
050519 - [On 060605 CSAA reviewed Millie's report of evidence showing the
050520 - other motorist was responsible for the automobile accident on
050521 - 060215, and there were no damages, ref SDS 3 4153; this evidence
050522 - led CSAA to revise the initial determination and find that Millie
050523 - was only 50% responsible, ref SDS 3 HV5I, as a result, there will
050524 - be no impact on Millie's insurance rates. ref SDS 3 416F

0508 - Progress
0509 -
050901 - At approximately 4:55p, leaving the Concord BART station at 1451
050902 - Oakland Avenue, Millie was turning left to go East on Oakland Avenue
050903 - toward Clayton Road, and in order to stop at Longs Drugs across the
050904 - street from the station. Oakland Avenue is a four-lane road, with two
050905 - lanes in each direction that accomodate traffic to and from the
050906 - station.
050908 - ..
050909 - While stopped at the exit leaving the station, she saw only one car
050910 - coming, going East, on the inside lane. The oncoming car seemed to be
050911 - speeding up. After it past traveling approximately 30 MPH, Millie
050912 - turned and observed there was no West bound traffic, and further saw
050913 - the car that had just past continuing toward Clayton Road. Seeing the
050914 - road clear in both directions, Millie pulled into the same inside lane
050915 - going East on Oakland Avenue. Millie checked the rear view mirror and
050916 - noticed an approaching car behind her though in the far right lane,
050917 - not the inside lane, which she had just entered.
050919 - ..
050920 - Turning attention to the road ahead, she was suddenly forced to use
050921 - the brakes, because the car that had just passed going East, suddenly,
050922 - and without notice, stopped to wait for oncoming traffic to clear in
050923 - order to make a left hand turn into the BART station, approximately
050924 - 100 yards from where Millie had just exited to enter onto Oakland
050925 - Avenue.
050927 - ..
050928 - This sudden change in positioning of the East bound vehicle without
050929 - notice of a left turn signal, required immediate action to avoid
050930 - serious accident.
050932 - ..
050933 - Millie stopped her car at a point that may have touched the stopped
050934 - car. Millie's car did not slide, skid nor experience any loss of
050935 - control, and further did not collide nor bump the other car with any
050936 - noticable force.
050938 - ..
050939 - The women driving the car got out of the car, opening the door into
050940 - the path of oncoming traffic, causing a severe road hazard.
050942 - ..
050943 - Millie immediately recommended that the woman get back into her car
050944 - and pull into the BART station in order to avoid a devestating
050945 - accident with heavy traffic during rush hour, in darkness and bad
050946 - weather.
050948 - ..
050949 - When the other motorist accelerated from a stop to turn left across
050950 - traffic into the BART station, her head bobbed back and bumped the
050951 - head reast, in accordance with product design.
050953 - ..
050954 - Millie followed the woman into the BART station. Her head also bumped
050955 - against the headrest. They found a space to park, and then
050956 - investigated the event. The woman provided identification...

050968 - They both examined the other motorist's car and found no damage.
050969 - There were a few disparate tiny paint spreckles missing on the bumper,
050970 - consistent with wear from road dust. There was no evidence of
050971 - collision nor bump of sufficient force to evidence damage or injury.
050973 - ..
050974 - They examined Millie's car and noticed a few tiney speckles of paint
050975 - missing on the bumper, which had preceeded the accident, also, from
050976 - road dust. There was no evidence of collision nor bump of sufficient
050977 - force to evidence damage or injury of any kind.
050979 - ..
050980 - These findings are consistent with a force of vehicles merely
050981 - touching, rather than colliding or bumping.
050983 - ..
050984 - Ms Lewis said her head bumped against the headrest of her car,
050985 - consistent with accelerating to turn left into the BART station and
050986 - avoid oncoming cars during rush hour, as observed. ref SDS 0 RP9K
050988 - ..
050989 - Examination of the scene showed no skid marks for either car,
050990 - consistent with absence of forced stop due to collision or bump.
050991 -
050992 - [On 060605 CSAA reviewed Millie's report of evidence showing the
050993 - other motorist was responsible for the automobile accident on
050994 - 060215, and there were no damages, ref SDS 3 4153; this evidence
050995 - led CSAA to revise the initial determination and find that Millie
050996 - was only 50% responsible, ref SDS 3 HV5I, as a result, there will
