Gentlemen:

As you know, I have called you on several occasions in the past few months, to follow up on your final payments for arbitrator compensation and expenses, which were outlined in my September 28, 1998 letter.

At the request of the arbitrator, I am re-capping what we have discussed during our conversations:

  1. Mr. Keiley, your assistant Mary reiterated again today that your office has been forwarding the bills to your client, and that the bills would get paid. She said today that she was unclear what the hold-up was.

  2. Mr. Langford, in our last conversation on October 28, 1998, you said that you had left messages for your client, and that he may have been out of the country. You said you would let me know as soon as he got in touch with you.

Although we requested this information from the parties in our September 28, 1998 letter, no party has confirmed the settlement of this matter in writing. However, based on advice from the parties, we must conclude that this matter has indeed settled.

Therefore, please be advised that as of this date, the San Francisco office of the American Arbitration Association has closed its file. However, any administrative/arbitrator fees still outstanding remain due and payable.

The next step for collecting the arbitrator compensation is listing your outstanding balances with the collections agency of Dunn & Bradstreet. This will occur within the next two weeks, unless the necessary payments are made with this office.
