Attached are notes of understandings Kwan Henmi has drawn from meetings with consultants on the project, including instructions and information you have offered, as set out in the notice of the meeting note form. which states in pertinant part that Kwan Henmi...

... will rely on these notes ... unless written notice to the contrary is received... within seven calendar days...

These notes have not been distributed previously due to the following reasons:

  1. Gensler has issued mixed instructions on procedures.

  2. Accelerated schedule under Gensler's direction has reduced time for review to ensure a record that supports the project design. The complex design requires careful review, which has extended the period.

  3. Change in personnel elevating Robert Rudeen to supplement KH management on project required adjustments in review procedures which have taken time to implement.

  4. Gensler's Project Manager was off-site, and so unavailable for consultation on procedures.

As project manager for the JV team, please make distribution to affected consultants so that there is a single point of official contact for the Joint Venture, as discussed on October 7, 1998, and previously at the JV Coordination meeting on September 29, 1998.

Given the complexity and accelerated pace of the design, and other conditions of the work directed by Gensler, Kwan Henmi maintains and hereby notifies Gensler that heightened scrutiny of communications for alignment with requirements is essential for success of the project, particularly in relation to potential claims during construction, and utility after commissioning.

If Gensler has any additions or corrections for consideration in advance of distribution, please let me know, so that the notes can be conformed to reflect understandings of the JV team, in advance of distribution to others. Gensler's questions should be submitted in writing to avoid distractions in the Project Office caused by personality and verbal communication.

Please provide to Kwan Henmi a copy of the JV transmittal of these notes, to complete our record and facilitate communication with the consultants.
